According to the terms of the deal YouTube struck with Sony/BMG, this is also supposed to apply to fan-made lip-syncs and the like as well.  Hence, AudibleMagic's technology can conceivably just recognize the audio and ignore the video.  But you're right -- just a snippet, or, say, audio from an ambient source such as a boombox might not be so easily recognized.
