Hmmm... it would appear that even the workplace has now become an extension of the h.s clique at its MOST BIZARRE; where the internet is now the mass and world disseminated "slambooks" from decades past.

While some might think to excuse this manager's cc'd email as just another humorous and just dessert for a serial lacker - it truly suggests that the manager is ill-suited for managing the personnel under his direction.

Unfortunately... the intern naively set himself up for this...silly him. But, as a HR professional, I find his manager just as petty and juvenile; and if the intern cares to check into his personnel rights -he might find that this manager's email forms the basis for a serious lawsuit on the premise of harassment, and haaving established a "hostile working envirronment" as a result of this. 600k+ views of it here alone - constitutes undue duress.

Y'all need to STOP PLAYING online and with your livelihoods, present and future. H.S. is OVER... !! Get a grip - and a real life. Some things now one can never get beyond... thanks to the WWW.

Maybe he really did have a family emergency to deal with, and made a side trip up to Mass to visit some friends though. I don't see the big deal with that. If he really was an unpaid intern, it's doubly stupid to make an employment issue out of this. My reply would have been "OK, dock my pay for the days I was missing."

But I've never been a fairy, either. Not even for Halloween.

I don't care if he dressed up as a fairy or a footballer, or where he did it. Or whether he was an intern or an employee. The bottom line: instead of just saying, hey guys, I'm taking a personal day (pretty easy to do if you're an intern, esp. an unpaid intern without a compelling interest in what you're doing) he displayed a lack of ethics. (His v. careful wordng reminds me of Bill Clinton on the subjects of marijuana use and Monica Lewinsky...)
It's not about whether what he choice to lie about was a big deal -- whether he stole, cooked the books a la Enron, slept with the boss's wife, blah, blah, blah -- but the fact that he thought it was OK to mislead his bosses. What he's lying about isn't the issue. But why would I trust someone who lied to me? I might not be crazy about having a single mom or older guy needing more time off to deal with personal stuff, but (a) they're being forthright and (b) I get a chance to judge whether they are setting their priorities right. With this guy, I'd never know what he might do next. Maybe in a year or two he'd decide that it was OK to, say, approve a loan for a buddy with bad credit and cover up the violation with faked documentation. After all, all the Enron crooks got the idea somewhere along the line that it was OK to lie, and that there were no consequences for doing so. I know lots of investment bankers and traders who would see this guy's cavalier attitude as a big risk.
I'm a bit surprised that this guy was apparently interested enough in Anglo Irish to take an internship, but not enough to sacrifice a single Hallowe'en party. If he did end up getting shown the door, it was probably a good thing for both sides. Most of the interns I've known over the years have been too keen on breaking into their chosen field to run the risk of being busted over something stupid. I feel bad for the guy who might have otherwise gotten this intern spot, but was passed over in favor of an unethical jerk.
As for Facebook, who cares if your employee is a party animal? I think the vast majority of bosses/potential bosses out there can and will distinguish between something that's adolescent & college behavior, and stuff that is more worrying -- violence, extreme racist attitudes, etc. And also between what someone is posting about themselves vs what others are saying about him.

I don;t understand what the confusion about the legalities is. He put it up on his facebook that presumably many of his co-workers or even his boss would have ready and easy access to, ESPECIALLY if the boss was a member of a group of his (office group, co worker group, whatever) profile. Can't guilt him for checking profiles of people he shares groups with. Therefore the employee could reasonably assume that his boss would find out, no different than passing a memo or email that ends up with your boss. Face-book is all good and fine, but people need to be more careful. And if you are going to ditch work on false pretenses, whatever they are (He said going to NYC when he did not, implying most likely a family emergency...) don't advertise the fact.

Jesus, he deserves to be fired. I don;t guilt a guy for partying, and at that age I;m sure everyone has ditched a few days to party once in a while. But the fact he was an idiot and posted it on his facebook...he deserves to be fired. Lesson learned, move on, get a new job.

let's relax for a second. Yes, that is the most feminie costume of all time and his boss called him out in the most hilarious way possible, the boss is at fault. The issue is that Kevin intentionally misled him with an excuse for missing work and he got caught for it (albeit in the worst/embarassing way imaginable). But an employer/employee situation needs to be treated in a private fashion. The boss was wrong for forwarding that to the rest of the office (yes, malicious but also hysterical) when he clrearly knew how embarassed Kevin to be while facing his co-workers, but at the same time underestimating how many people (email tends to spread quick, Davis) would find this wildly entertaining and thus defaming the kid.

believe me, im not taking a moral stance here. but essentially he's being a drunk college guy who wanted to spend Halloween with his friends. it's really not that uncommon. he just got stuck in an incredibly unlucky situation where both he and his boss made errors in judgment

not every picture of a person on facebook, myspace etc. is posted by the subject. anyone can title a photograph using your name on a flikr or tag a photograph using your name on facebook without your consent or even you knowing.

My opinion is that the employee shouldn't have lied about why he was taking the day off. So I believe it was fine (and funny) for his boss to send him an email with the pic attached basically letting him know he shouldn't have lied. However, sending it off in a mass email would constitute "public shaming" and would resonate with harassment. I think both people could have been written up for different reasons. But that's my opinion, which could easily be swayed by facts. None of which you offered.

All this fair and legal stuff is a facade anyway. In many states, they don't even have to specific reason to fire you (Re: 'at will' employment).

Any hiring is presumed to be "at will"; that is, the employer is free to discharge individuals "for good cause, or bad cause, or no cause at all," and the employee is equally free to quit, strike, or otherwise cease work.

Only a handful of states (like 10 I think) have a 'just cause' rule but cutting work under an ambiguous excuse to go to a party certainly would be one.

Most of the time to get past that you'd have to sue for something on the basis of race, color, religion, sex, national origin, age, or handicap status. Meaning not checking out a facebook.

I've seen posted the idea he's an intern so what - well wait until a prospective employer for a real paying job googles his name. I suspect he's going to have a harder time getting a job due to this.

I have myspace, facebook, flickr, wordpress and a personal website that also runs gallery - they are all public but I don't post anything really personal there. I have a private livejournal account where I bitch and complain. I know we all want to be connected but you have to have levels of access.

Last night I was 90 mins late to work on project online with a colleague. I didn't mention it was because I was at a basketball game with my kid and I certainly didn't post photos of the game last night.

first thing off the bat, just so everyone knows my perspective - i'm a bit old-school ... everyone is responsible for their own actions.

folks such as "SILVARGA": "Is it legal (HR-wise) to check out someone's personal Facebook page and ...".

what a wimpy, irresponsible attitude! it's all about how the employer might have reacted (i.e. irresponsibly) to this obvious lie. it's the typically lame "find something to sue them about because they embarrassed me", even though the employee is in the wrong.

and how about "EZE's" response ... the same wimpy, shift the blame to others that arent truly responsible for their actions: "I'm almost certain its is a violation of Facebook's terms of service to take a photo from the site and use it elsewhere."

this kid, "Kevin Colvin", is obviously guilty. and yes, i understand how it is being that young - we all acted irresponsibly - it's a part of growing up. obviously, someone just out of college hasn't "got it" yet (well, it's rare one would).

what irks me is the folks that think the blame should go to the employer. it's an absolutely wimply attitude and it's an attitude one in of itself that is irresponsible.

Kevin made this sound as if something was up (wrong) with the family and did something else. yes, he was ambiguous for a reason.

I'm almost certain its is a violation of Facebook's terms of service to take a photo from the site and use it elsewhere. The company went around fighting college newspapers for using photos from Facebook for stories.

I'm willing to bet that whoever took the fairy photo off Facebook will get their account disabled.

In fact, the more Facebook lets its users get abused for what they post, the more those users will post less interesting/incriminating things. This will make the site more boring, which is possibly the worst thing that can happen to a social network.

I run a design firm in Los Angeles, and I thought I would register to give a warning and to enlighten a few posters as to what is "lying". First of all, if you are scheduled to work, and have to miss a few days for "family", then dressing up in a fairy outfit with a beer in your hand WILL be construed as lying. Unless you live with a band of alcoholic fairies, and this was a wake.

Something else I thought people might be interested in or heard about is the use of Facebook and Myspace during job applications. I cannot tell everyone enough how many people get turned down for jobs all over Los Angeles because after a great interview, we Google their name, and eventually trace Youtube, Myspace etc. and find all the drunken pictures, idiotic racist comments etc. Be very careful using your real name on the internet.

Is it legal (HR-wise) to check out someone's personal Facebook page and forward embarrassing pics copied from the site to the entire office? Lame out-of-office excuse or not, doesn't the act of mass emailing the pics constitute harassment?

Why would an intern bother to come up with an excuse anyway? It's not like they get paid...
