Bank intern busted by Facebook

Kevin Colvin, busted by FacebookWho says Facebook is the province of the young? Increasingly, the 30something bosses of naive recent college grads are proving adept at turning the social network against its earliest adopters. Kevin Colvin, an intern at Anglo Irish Bank's North American arm, was busted when he told his manager, Paul Davis, that he'd miss work due to what colleagues took to be a "family emergency". Davis turned up the photo above, freshly posted to Facebook from the Halloween party Colvin apparently missed work to attend, and attached it to his reply, copying the rest of the office as he did it. The email thread is now spreading around the net. After the jump, the entire exchange, and the incriminating photo.

  • Is it legal (HR-wise) to check out someone's personal Facebook page and forward embarrassing pics copied from the site to the entire office? Lame out-of-office excuse or not, doesn't the act of mass emailing the pics constitute harassment?

    Why would an intern bother to come up with an excuse anyway? It's not like they get paid...

  • What I hate is lying. No where in his e-mail does he say Family Emergency. In fact he was 100% honest just not specific. Something (this party) came up. Nothing dishonest in that. WHAT came up is of no relevance to the boss IE he has no need to know the specifics.

    On the other hand his bosses creative use and response to finding out the specifics is hilarious deserves a pat on the back :-)

    @Nerys: While he may not of "technically" lied, his e-mail was intentionally misleading. He knew that it would be interpreted that it was a family emergency. Very slimey.

  • I run a design firm in Los Angeles, and I thought I would register to give a warning and to enlighten a few posters as to what is "lying". First of all, if you are scheduled to work, and have to miss a few days for "family", then dressing up in a fairy outfit with a beer in your hand WILL be construed as lying. Unless you live with a band of alcoholic fairies, and this was a wake.

    Something else I thought people might be interested in or heard about is the use of Facebook and Myspace during job applications. I cannot tell everyone enough how many people get turned down for jobs all over Los Angeles because after a great interview, we Google their name, and eventually trace Youtube, Myspace etc. and find all the drunken pictures, idiotic racist comments etc. Be very careful using your real name on the internet.

    @deathbychichi: I don't know the specifics, but one likely scenario is that Colvin joined his employer's Facebook network, exposing his profile to all his new coworkers.

  • I'm almost certain its is a violation of Facebook's terms of service to take a photo from the site and use it elsewhere. The company went around fighting college newspapers for using photos from Facebook for stories.

    I'm willing to bet that whoever took the fairy photo off Facebook will get their account disabled.

    In fact, the more Facebook lets its users get abused for what they post, the more those users will post less interesting/incriminating things. This will make the site more boring, which is possibly the worst thing that can happen to a social network.

  • Your headline says "Privacy is an Illusion", and as true as this might be, it really doesn't apply here. If your goal is to have some privacy it's up to you. Have a Facebook, Myspace, YouTube channel or a Flikr account and you post items that might get you into trouble and well, we all know the rest. So, if your ego makes you publish your every move online, don't cry when it gets you busted using sick days for partying purposes. Hell I'd fire your ass in a hot second, but not before making you work a whole day in the fairy outfit cause, well, it's kind of hot.

This kid is a work-skipping twit who clearly isn't smart enough to work at a bank. And if you put a non-copywrited picture on the web it is fair game (and it was sent to the boss, not retrieved by the boss). I grew up in Worcester and loved the line about lying to get out, not in. And I also agree that you don't have to lie to skip a job that doesn't pay you. Angloirish would probably appreciate the honest (drinking/banged-up) truth.

    this kid, "Kevin Colvin", is obviously guilty. and yes, i understand how it is being that young - we all acted irresponsibly - it's a part of growing up. obviously, someone just out of college hasn't "got it" yet (well, it's rare one would).

    what irks me is the folks that think the blame should go to the employer. it's an absolutely wimply attitude and it's an attitude one in of itself that is irresponsible.

    Kevin made this sound as if something was up (wrong) with the family and did something else. yes, he was ambiguous for a reason.

    if Kevin was to be truly adult and take responsibility, he would have said (before the event), or asked, "i would like to take a vacation day ..."

    Well, I don't think it is an illusion... afterall, is a facebook/myspace/orkut web page actually private?
    If you want real privacy, build up a blog with access levels and groups, required login and stuff.

    If you post it public, how can you request privacy?

  • what gets me is how many people will defend other people for doing stupid shit. Kids ya got a job you are expected to go to it not lie about it and be stupid enough the Next day and document it. Basically if you are a whore, drunk or just plain stupid stopping letting the world know about it and than complaining about the fact that your privacy is being violated. The level of me in this world is astounding. You wanted to be a star well everyone now knows your name welcome to the club. Your privacy is in your control and respect for yourself.

  • All this fair and legal stuff is a facade anyway. In many states, they don't even have to specific reason to fire you (Re: 'at will' employment).

    Any hiring is presumed to be "at will"; that is, the employer is free to discharge individuals "for good cause, or bad cause, or no cause at all," and the employee is equally free to quit, strike, or otherwise cease work.

    Only a handful of states (like 10 I think) have a 'just cause' rule but cutting work under an ambiguous excuse to go to a party certainly would be one.

    Most of the time to get past that you'd have to sue for something on the basis of race, color, religion, sex, national origin, age, or handicap status. Meaning not checking out a facebook.

    I've seen posted the idea he's an intern so what - well wait until a prospective employer for a real paying job googles his name. I suspect he's going to have a harder time getting a job due to this.
